Terms & Conditions

These Terms of Service govern the use of all services provided by A.R.I.A Mobile, including eSIM products, connectivity services, subscriptions, top-ups, business services, customer portals, websites, applications and support services.

Important notice

By purchasing, downloading, activating or using any A.R.I.A Mobile service, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use our Services.

1. Definitions

  • "A.R.I.A Mobile", "we", "us" and "our" means A.R.I.A Mobile, a telecommunications and connectivity services provider operating from the United Kingdom.
  • "Customer", "you" and "your" means any individual, business, organisation or entity purchasing or using our Services.
  • "eSIM" means a remotely provisioned digital SIM profile.
  • "Service" means any connectivity, subscription, top-up, support, account, portal or related service supplied by A.R.I.A Mobile.
  • "Network Partner" means any third-party mobile network operator, roaming provider, wholesaler, carrier or infrastructure provider used to deliver Services.

2. Eligibility

You must have legal capacity to enter into a binding contract in your country of residence. Where local law requires a minimum age to purchase telecommunications or digital services, you must satisfy those requirements before purchasing Services. By purchasing Services, you warrant that you meet all applicable eligibility requirements.

3. Nature of Services

A.R.I.A Mobile supplies data connectivity services using eSIM technology through third-party telecommunications infrastructure. Unless expressly stated otherwise:

  • Services are data-only.
  • Services do not include voice calls.
  • Services do not include SMS messaging.
  • Emergency calling services may not be available.
  • Network availability varies by country and location.

4. Coverage and Network Availability

Coverage is provided through third-party network operators and roaming partners. We do not own or operate mobile network infrastructure. Coverage maps, speeds, latency, availability and performance are estimates only. We do not guarantee:

  • Continuous availability.
  • Minimum data speeds.
  • Availability in all locations.
  • Availability during maintenance periods.
  • Availability during network congestion.
  • Availability in restricted jurisdictions.

5. Orders and Activation

Services are supplied digitally. Following successful payment:

  • eSIM profiles may be provisioned automatically.
  • QR codes may be delivered electronically.
  • Activation credentials may be delivered electronically.
  • Orders may require verification before fulfilment.

6. Digital Content Acknowledgement

By purchasing an eSIM or digital connectivity product, you expressly request immediate digital fulfilment. You acknowledge that once digital fulfilment begins, your statutory cancellation rights may be reduced or extinguished to the fullest extent permitted by applicable law. Digital fulfilment includes:

  • eSIM creation
  • ICCID allocation
  • QR code generation
  • activation code generation
  • profile assignment
  • data bundle assignment

7. Customer Responsibilities

You are responsible for:

  • Ensuring your device supports eSIM technology.
  • Ensuring your device is unlocked where required.
  • Maintaining account security.
  • Protecting activation credentials.
  • Using Services lawfully.

8. Prohibited Activities

You must not:

  • Engage in unlawful activity.
  • Abuse telecommunications networks.
  • Attempt to compromise platform security.
  • Circumvent technical restrictions.
  • Resell Services without written permission.
  • Use Services in violation of sanctions laws.
  • Engage in fraud or deceptive activity.

9. Business and Fleet Services

Business and fleet customers may be subject to additional contractual terms. Business customers are responsible for authorised users operating under their account. Fleet services may be suspended where billing obligations are not met.

10. Pricing

Prices displayed at checkout are the prices payable at the time of purchase. Prices may change without notice for future purchases. Previously completed purchases are unaffected unless expressly stated otherwise. Taxes, duties or local regulatory charges may apply depending on jurisdiction.

11. Subscriptions

Subscription Services automatically renew unless cancelled. Customers may manage subscriptions through their account portal. Cancellation takes effect at the end of the current billing cycle unless otherwise stated. No refunds are generally available for partially used subscription periods.

12. Intellectual Property

All branding, software, designs, content, trademarks and intellectual property associated with A.R.I.A Mobile remain our property or the property of our licensors. No ownership rights are transferred to customers.

13. Limitation of Liability

To the maximum extent permitted by law: A.R.I.A Mobile shall not be liable for indirect, incidental, consequential, special or punitive losses. Our aggregate liability arising from any claim shall not exceed the amount paid by the customer for the affected Service during the twelve months preceding the claim. Nothing in these Terms excludes liability which cannot legally be excluded.

14. Force Majeure

We shall not be liable for failure or delay caused by circumstances beyond our reasonable control, including:

  • Network failures
  • Power failures
  • Government action
  • Sanctions
  • Cybersecurity incidents
  • Natural disasters
  • Telecommunications outages
  • Third-party infrastructure failures

15. Data Protection

Personal data is processed in accordance with our Privacy Policy. Customers acknowledge that telecommunications and connectivity services require the processing of technical identifiers including ICCIDs, device information, network information and service usage data.

16. Suspension and Termination

We may suspend or terminate Services where:

  • Payments fail.
  • Fraud is suspected.
  • Legal obligations require action.
  • Abuse is detected.
  • Security concerns arise.

17. Sanctions Compliance

Services are not available in jurisdictions subject to applicable sanctions, export restrictions or legal prohibitions. We reserve the right to restrict access where required by law.

18. Changes to These Terms

We may amend these Terms from time to time. Updated versions will be published on our website. Continued use of Services constitutes acceptance of revised Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Scotland. The Scottish courts shall have exclusive jurisdiction except where mandatory consumer protection laws provide otherwise.

20. Evidence of Delivery

Where records maintained by A.R.I.A Mobile, its payment providers, telecommunications providers or infrastructure partners demonstrate that an eSIM profile, ICCID, QR code, activation code, data bundle or related service has been provisioned, assigned, downloaded, activated or used, such records shall constitute prima facie evidence of successful service delivery unless proven otherwise.
